Terms and Conditions

 

Please read the terms of sale carefully before placing your order and retain a copy of these terms and your order for future reference.

 

1.The contract between ROJO and our customer

 

1.1 The contract entered into is between ROJO, whose registered office is at 1/5 Alfred Street, London, E3 2BE, company registration number 3386016, and you, the customer, based upon the information provided on the order form.

 

1.2 The contract is only made once cleared payment has been received. (see section 3.1)

 

1.3  We will send an order confirmation by email once cleared payment has been received, informing you that your goods will be despatched within 2 working days. 

 

1.4 In the event that, after cleared payment has been received, we discover that the goods are not available we reserve the right not to supply the goods ordered and offer a refund. In this event we will contact you by telephone or email.

 

1.5 If more than one product has been paid for, and only part of the order is available, we reserve the right not to supply the unavailable item(s) and offer a refund for the unavailable item(s) only. In this event we will contact you by telephone or email.

 

1.7 We have the right to cancel the contract if the total order value is not received from you in cleared funds.

 

2. Description and price of goods

 

2.1 The description and price of the goods you order will be as shown on our website at the time you place your order.

 

2.2 Every effort has been made to ensure that the description and price of the goods detailed on our website is accurate.

 

2.3 The product price on the website is inclusive of any payable value added tax in the UK.

 

2.4 The product price on the website does not include delivery charges. (see section 4)

 

3. Payment

 

3.1 Goods will not be despatched until we have notification that the payment has been cleared.  In the event of a payment being declined, we will consider the contract terminated, and goods will not be despatched.

 

3.2 In the event of a refund being necessary, refunds will be made only to the credit or debit card used for the original transaction.

 

4. Delivery

 

4.1 Goods can only be delivered to the address to which your card is registered.

 

4.2  All deliveries will be sent by first class Recorded Signed For TM post.  Upon receipt of your order you will be asked to sign for the package.  We will not accept responsibility for claims of undelivered goods if the delivery address matches that supplied  by you at the time of placing your order.  Please ensure that you are available to take delivery of the package.

 

4.3 Every effort will be made to deliver the goods within the timescale promised. However, we will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery.  Such reasons may include no one being available to sign for the delivery, or extended delivery time at Christmas. 

 

5 Returns Policy

 

5.1 You have the right to return your goods to us if you are not satisfied with them. You must return the items within 14 days of receipt, in exactly the condition that you received them. You may request replacement products (subject to availability)  which will be despatched to you on receipt of the original products.  This will be considered a new order.  The cost of the original order will be refunded, less delivery charges. In the event that replacement products are not available, a refund will be issued for the original products, less delivery charges.

 

5.2 In the unlikely event that your goods are faulty, you may return the items to us within 28 days of receipt.  If we conclude that the products are faulty, replacement products will be despatched to you (subject to availability). Your return postage costs will be refunded. In the event of no replacement item being available, you will be given a full refund, to include your return postage costs. (see section 5.4)

 

5.3 Returned items must be posted to us using Royal Mail Recorded Signed For TM

 

5.4 In the event that a refund is due to you for return postage, the amount refunded will be in accordance with our standard delivery charges (see section 4)

 

6 Risk and property

 

6.1 Risk of damage or loss of your chosen products shall pass to you upon delivery.

 

6.2 We will not be held responsible for any damage to products if you use any cleaning or other maintenance products other than those recommended by the manufacturer.

 

7 Warranties

 

7.1 We warrant that you will be entitled to the benefits of any warranties or guarantees given to us by the manufacturer. 

 

7.2 You warrant that the information entered into on the order form is true.

 

7.3 Where we sell to you under a consumer transaction as defined by the Customer  Transactions (Restrictions on Statements order 1976) your statutory rights are not affected by this agreement.

 

8 Force Majeure

 

We shall not be liable to you or deemed to be in breach of this agreement by reason of any delay in performing or any failure to perform any of our obligations if the delay or failure was due to any cause beyond our reasonable control. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond our reasonable control:

 

8.1 Act of God, explosion, flood, tempest, fire or accident

 

8.2 War or threat of war, sabotage, insurrection, civil disturbance or requisition

 

8.3 Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority

 

8.4    Import or export regulations or embargoes

 

8.5    Strikes, lock-outs or other industrial actions or trade disputes (whether involving  our employees or those of a third party)

 

8.6    Power failure or breakdown of machinery

9 General 

 

9.1 If any provision of this agreement is held by any competent authority to be invalid or unenforceable in whole or in part validity of the other provisions of this agreement and the remainder of the provision in question shall not be affected thereby.

 

9.2 The contract shall be governed by the laws of England.

 

9.3 The terms and conditions set out in this agreement represents the entire agreement.

 

10 Data Protection

 

We will take all necessary precautions to ensure that personal data is protected.  Personal data excluding credit or debit card details will be stored for information and/or marketing purposes.
